PRELIMINARY ARTICLE: SCOPE OF APPLICATION


These General Terms of Sale (GTS) apply, without restriction or reservation, to all sales concluded by the ASSOCIATION "Agile Community of Montreal" to non-professional buyers referred to as "Participants" or "Customers" within these GTS.
As part of the Montreal Agile Tour event, the association organizes two days of online and face-to-face congress in a dedicated building that can accommodate several thousand people. During this congress, customers will participate in conferences, workshops, keynotes, and all activities related to agility.


In order to attend, tickets are offered for sale exclusively via our website.


These GTS in particular specify the conditions for immediate purchase, placing orders, payment, and delivery or collection of the ordered tickets.


Ticket offers are subject to availability.


These GTS apply to the exclusion of all other conditions.


These GTS are systematically communicated to all participants prior to immediate purchase or order placement and will prevail, if necessary, over any other version or any other contradictory document.


The Participant declares having read and accepted these GTS before their immediate purchase or the placement of their order, it being specified that the payment implies their acceptance.


By placing their order, Participants declare that they have read and accepted these general terms of sale.


They have also read and accepted the admission conditions mentioned on the website and the ticket office. For example, each participant is required to register via the vFairs platform to access their tickets.


These General Terms of Sale may be subject to subsequent modifications, the version applicable to the Participant's purchase is the one in force at the date of immediate purchase or order placement.

ARTICLE 1: GENERAL CONDITIONS


Tickets are non-transferable. They are neither taken back, nor exchanged except for date or time error on the ticket, nor refunded in case of loss or theft. No duplicate will be issued.


Their resale is prohibited. The ticket must be presented at the reception desk upon your arrival.


It is the Participant's responsibility to verify the accuracy of the order and to immediately report any errors.


Participants are warned that video clips are shot and photos are taken for the needs of the association's communication during and after the event, so their image is likely to appear.


By purchasing tickets and participating in the Congress, Participants therefore authorize the use of their image. Consequently, they cannot subsequently blame this use on the association or use this circumstance to claim any damage entitling them to compensation.


The management reserves the right to modify schedules and programs. Changes in schedules, program on the day of the event cannot give rise to a refund except in case of complete cancellation of the event. In the latter case, only tickets will be refunded.
The customer's failure to show up at the congress or any cancellation of their own without prior agreement from the association will only result in a ticket refund under the terms provided in paragraph 2 of Article 5. Transportation and accommodation costs, cloakroom fees remain the responsibility of the participants.

ARTICLE 2: RATES


Ticket prices are indicated in Canadian Dollars excluding taxes including fixed management fees of $15CAN at the time of booking.


Only online payment by credit card or Paypal is allowed.


Ticket prices vary depending on the period or type of ticket at the time of purchase.

ARTICLE 3: ONLINE RESERVATION

Availability

Ticket reservation is done in real time. Our server informs you in real time about the availability at the time of your order. During your reservation, the "my basket" page is a summary of what you are about to order. This page only informs you about the current order. This page does not constitute proof of firm reservation. The order is only final once the payment is validated and the receipt of purchase confirmation on your email. The Agile Community of Montreal cannot be held responsible for errors made by the buyer when ordering (name, surname, address, email address, incorrect card number...).

Payment

Payment by credit card or Paypal corresponds to a firm and definitive purchase as long as your payment is accepted by your bank. The credit card or Paypal payment system is equipped with a security protocol that allows you to make your transactions safely.

Order confirmation

You will receive an email confirming the purchase of your seats for the Congress. This email serves as proof of purchase and comes from VFairs. You will also receive a payment confirmation from Paypal. Therefore, we invite you to check your email and save the confirmation email. In case of non-receipt of this email, check your spam folder and then send us an email at info@agiletourmontreal.com

Obtaining tickets

You receive them directly in your mailbox with the message confirming the purchase of your seats. You will access your tickets directly via the VFairs portal.

Obtaining the invoice

Following the purchase of your ticket, if you wish to receive the detailed invoice indicating the GST/QST, we invite you to send an email to info@agiletourmontreal.com.

ARTICLE 4: MODIFICATION OR CANCELLATION OF AN ORDER

1) Modification due to the client

The client who has already made reservations and whose payment has been made by credit card or Paypal can add a new order to his basket. However, he cannot modify the tickets of a paid order by himself without first contacting the Agile Community of Montreal association by email at info@agiletourmontreal.com Since tickets are named, the transfer of a ticket from one person to another is not possible.

2) Total cancellation by the client

Any total cancellation of an order must be notified to the Agile Community of Montreal association via email: info@agiletourmontreal.com The Agile Community of Montreal will keep the full amount of the order for any cancellation within less than 10 days of the event date. In the case where the Participant cancels more than 10 days before the Agile Tour of Montreal event, the participant may request a refund of the price of his ticket. However, the Agile Community of Montreal will retain the fixed fee of $15CAD on the ticket price. The refund will be made directly to the account of the Credit Card or your Paypal account indicated at the time of the ticket purchase within a maximum period of 15 days.

3) Modification or cancellation due to a service provider

In case of force majeure or the cancellation of a partner or supplier of the Agile Community of Montreal, the participant must either terminate his reservation and obtain a refund, or accept the proposed modification, after having been informed. In case of non-response from the "Participant" within a period of 15 days, the Agile Community of Montreal will consider that the "Participant" accepts the proposed modifications. No refund will then be possible.

No-show

The non-presentation of the Participant at the reception desk does not entitle to a refund. The Agile Community of Montreal then retains the total amount of the order.

ARTICLE 5 - Disclaimer for stolen or damaged material

The Agile Community of Montreal declines all responsibility in case of theft, loss or damage caused to material belonging to participants or third parties during the event. Participants are responsible for the security of their personal belongings and are encouraged to take the necessary measures to ensure their protection.

Participants acknowledge and accept that the Agile Community of Montreal cannot be held responsible for any theft, loss or damage that occurred during the event, whether due to intentional acts, negligence or any other factor beyond the control of the Agile Community of Montreal.

Consequently, participants waive any recourse, claim or legal action against the Agile Community of Montreal in case of theft, loss or damage to their equipment during the event.

Participants are invited to take out adequate insurance to cover their equipment and any other valuable property during the event.

By purchasing this ticket, participants declare that they have read, understood and accepted the terms of this disclaimer regarding equipment stolen or damaged during the event.

ARTICLE 6 - CLAIM

Any claim relating to a reservation must be addressed to the Agile Community of Montreal by email at info@agiletourmontreal.com within less than 15 days after the event.

ARTICLE 7 - Confidentiality

This section aims to inform you about the personal information we collect, how it is used in the context of the Agile Tour of Montreal event, and about your rights.

1) What personal information is collected?

When you complete the event registration form, you consent to the Agile Community of Montreal collecting the personal information detailed below.

Certain data collected are marked as mandatory because they are essential for the successful execution of the contract or as part of the Canadian government's initiative to create more inclusive organizations. (Name, First name, Email address, password, your primary language, and your dietary restrictions/What gender do you identify with?/Are you a member of the Indigenous peoples of Canada?/Are you a member of a visible minority? Are you a member of an ethnic minority?/Are you a person living with a disability?).

Additional data are requested during your registration for the event, however, their communication is optional, and it is up to you to refuse to transmit them to us (Job title/Company/What industry do you work in?/What is your level of knowledge of Agility).

2) For what purposes are your personal information used? This section aims to explain how the Agile Community of Montreal uses your information.

For the execution of the contract concluded with you:

Process your registration for the event and identify you during your participation;

Communicate information related to the event, such as confirmations, reminders, or significant updates;

Personalize the experience of participants at the event, facilitate event organization in terms of logistics, set up specific accommodations if necessary, etc.

Better know the community participating in the event in order to improve the experience and better meet our goal of promoting diversity, inclusivity, and ethics

To assess the effectiveness of the event and improve the experience for future participants.

3) Who will have access to your personal information within the Agile Community of Montreal?

Under Article 2 of the Quebec P-39.1 Act, personal information is any information that relates to a natural person and allows that person to be identified. The Agile Community of Montreal takes all necessary precautions to protect your personal information in accordance with the applicable legal framework, including the Quebec P-39.1 Act - Protection of Personal Information in the Private Sector Act and Act 25.

4) Retention period of your personal data

Your personal information is kept for three years following their collection or following the last contact with a member of the Montreal Agile Tour organization committee.

5) Your rights regarding your personal information

Under the Quebec P-39.1 Act - Act on the Protection of Personal Information in the Private Sector, as well as Articles 37 to 41 of the Quebec Civil Code, you have the rights of access, consultation, and rectification concerning your personal information.

Your personal information belongs to you. Subject to legal, commercial or contractual requirements, you have the right to withdraw your consent to the collection, use, or disclosure of personal information.

To do so, you can contact us at info@agiletourmontreal.com, we will process your request as soon as possible. However, we specify that some information is essential to the performance of the contract. If you refuse to provide them, it may be difficult, if not impossible, to maintain the contract.

ARTICLE 8 - APPLICABLE LAW


These Terms of Sale are governed by the law applicable in the province of Quebec and must be interpreted in accordance with this law.


In the event that any particular provision of these Terms is deemed invalid by a competent court, this invalidity will in no way affect the spirit or scope of these Terms of Sale, all other provisions of which will remain enforceable.

ARTICLE 9 - DISPUTE RESOLUTION


In the event of a dispute, the parties agree to attempt to resolve the dispute through mediation before resorting to the judicial process.


Any dispute related to these Terms of Sale must be exclusively submitted to a competent court in the judicial district of Quebec, province of Quebec.
